Energy efficiency, applied in the field of architecture and construction, aims to reduce energy consumption while maintaining the same energy services without reducing comfort or quality of life of users.
It is expressed in “KgCO2 / m2 year,” measured variable that expresses the ratio of energy consumption and carbon dioxide emissions generated depending on the volume of a property for a year.
Such a result, following an analysis prepared by a competent technician (at project level new or existing building work), is reflected in a technical certificate called “Energy Performance Certificate” or often with acronyms E.P.C.
WHAT IS IT?
Royal Decree 235/2013 establishes the obligation to make available to buyers, users and tenants of buildings or parts thereof, a certificate must include objective information on energy efficiency with reference values in order for users to compare and assess the energy efficiency of the property. These reference values range between “A” (most efficient) and “G” (less efficient).
WHEN DID IT TAKE LEGAL EFFECT?
From June 1, 2013, all properties new build and second hand, both residential, and commercial, which is the subject of a sale or a rental, should have the identification label on Energy Efficiency which is part of an energy certificate – E.P.C.
WHO NEED REQUEST IT?
The duty to apply is any natural or legal person whose name is registered ownership of property, ie, the owner of the existing building or part thereof.
WHEN DOES IT MANDATORY?
- Buildings or new buildings of residential and tertiary use (local, shops, etc.
- Existing buildings or parts of buildings that are sold or leased, provided they do not have a certificate.
- Buildings or parts of buildings in which a public authority occupies a total useful floor area over 250 square meters and are frequented by the public.
WHO CAN DO IT?

WHAT VALIDITY DOES IT HAVE?
The energy performance certificate and its corresponding label are valid for a maximum of 10 years. The owner may voluntarily update it, when he considers that there are variations in aspects of the building or part of it that may modify the final qualification of the certificate. Likewise, it will have to be renewed when the property owner changes.
WHAT IMPACT HAS NOT COMPLY WITH THE DUTY TO OBTAIN THE ENERGY CERTIFICATE?
There are several consequences of not complying with the duty to obtain the energy certificate:
The competent government of Autonomous Community on energy provide the necessary certification to ensure compliance and detect cases of misrepresentation or fraud inspections.
The buyer / tenant may claim from the seller / renter for not fulfilling the General Law on Protection of Consumers and Users, impugning the contract and claim damages caused by the lack of information
Both the owner as the agency responsible for selling and / or leasing may be punished for the offence and may be fined financially. . The sanctions established by Article 51.1 of the legal text are:
- Minor infringements: up to 3.005,06 €
- Serious offences: 3.005,06 € – 15.025,30 €
- Very serious: 15.025,30 € – 601.012,10 €
