WHAT IS AN EXPERT REPORT?

This is a report drawn up by competent technicians in the field, who base their opinion on tests carried out on site to determine the damage that may have been caused by certain defects. The expert must be a third party, external to the process, and must always maintain neutrality.

HOW IS IT PRODUCED?

It is crucial to understand that this report is the result of an in-depth study, resulting from a meticulous examination through these different stages.  :

  • Collecting data and taking photos at the study site. The observation method is the first step, in order to consider the necessary tests.
  • Analysis of the documentation. Once all the necessary data has been collected, it's time to justify the veracity of the possible causes.
  • Drafting the expert report. The report must be clear and concise, with simplified technical language that is more accessible, even to people who are not specialists in the field.

WHAT DOES IT CONSIST OF?

The expert report on building defects must contain the following sections in a detailed, clear and concise manner:

  • Certify the construction defects, both in the private property and in any common elements, in order to be able to exercise the right of complaint.
  • Identify and justify the possible causes of the defects.
  • Present the appropriate solutions for remedying these defects, so that they return to a state of normality, both in terms of safety and aesthetics.

WHEN IS IT COMPULSORY?

The expert report will be mandatory in all processes where damage or defects caused are claimed from an entity. However, surveys can also be carried out to check compliance with current technical regulations.

WHAT LAW SUPPORTS ME?

Ten-year insurance is compulsory for buildings whose main use is as a dwelling. Law 38/1999 of Ordenación de la Edificación (LOE) establishes three periods during which liability can be claimed:

  • 10 years for damage caused by defects affecting foundations, beams, slabs and, in short, those that compromise the mechanical strength and stability of the building.
  • 3 years for defects in building components or installations that do not meet habitability requirements.
  • 1 year for defects in the finish of the building.

HOW LONG DOES IT TAKE TO OBTAIN A REPORT?

It takes about three days from the time you visit the property to collect and record the data, to the time you carry out the preliminary analyses and draw up the expert report. However, this time may vary depending on the additional tests or trials required.
