How can we be sure that our home or any other premises is in good condition? without posing a danger to the inhabitants, and also meets all technical requirements?

In order to identify and eliminate possible defects in a timely manner, it isvery important to know what condition our building is in and how correctly it is used. We are talking about both the aesthetic and constructive side of the issue, since by doing so we can avoid significant economic costs and even physical damage to residents.

For this reason, it is imperative that a competent technician periodically inspect the entire building or part of it — both during its operation and before starting work on its repair. In this way, we will be able to identify possible hidden defects in the building and optimize the costs of its repair.

For the audit to be completely legal and official, a technical report is required, which will reflect all technical aspects and details. It should be noted that there are three types of conclusions.

TYPES OF TECHNICAL CONCLUSIONS

  • Estate Evaluation Report (IEE) - A technical report indicating the location of the building, its compliance with current accessibility standards and class its energy efficiency. 
  • Investigation of Integrity (ICE) - A technical opinion that certifies the degree of preservation of a building or its parts and which is necessary for requesting assistance and subsidies from municipal authorities . 
  • Construction and technical report (ITE) - A document certifying the degree of safety of the building or its parts, which is necessary to understand the extent of the required technical and construction intervention .

These three types of conclusions apply throughout the country and, although they may have different names, ultimately have the same essence. Very often their purpose depends on the autonomous community in which the property subject to technical certification is located.

CONSTRUCTION - TECHNICAL REPORT

Construction and technical report (ITE) — This is an official technical document, certified by a competent technical specialist, which certifies the location of the building and its technical condition in accordance with current regulations.

WHAT IS THE POINT?

This is a conclusion about the technical condition of a building, which contains information regarding the technical condition of both its general elements and the energy characteristics of its thermal protection shell (roof, facades and thermal protection elements). The inspection allows you to identify possible damage or deterioration of the building and analyze its energy status in order to determine what repair and restoration measures may be required.

WHAT IS THIS GOVERNED BY?

This is a state standard — Law 8/2013 of June 26 — on urban recovery, renewal and reconstruction, published in the Official State Gazette (Boletín Oficial del Estado, BOE) number 153 of June 27, 2013. Section I of this law is devoted to the “Conclusion on the valuation of real estate,” and the most interesting articles in it are the following:

  • Article 4 - Conclusion on real estate valuation
  • Article 5 - Administrative approval
  • Article 6 - Preparation for the conclusion on the valuation of real estate 
  • First transitional provision - Calendar for the execution of the real estate valuation report 
  • Eighteenth final provision - Necessary qualifications for signing a real estate appraisal report 

WHEN IS THIS REQUIRED?

The conclusion is mandatory for building owners (as determined by government agencies) in the following cases:

  • when seeking help for the restoration and reconstruction of common elements of residential buildings;
  • if the building was built more than 50 years ago;
  • every 5 years after the above 50 years;
  • not necessary, but highly recommended in case of changes to design elements.

WHO IS RESPONSIBLE TO DO THIS?

Owners of real estate located in residential areas or residential buildings over 50 years old. This does not apply to single-family houses, unless required by regional or municipal regulations.

WHAT DOES IT CONTAIN?

The construction and technical report (ITE or ICE) first of all identifies the property by cadastral number and must contain detailed information on the following points:

  • assessment of the technical condition of the building;
  • assessment of the essential conditions for universal accessibility and non-discrimination of persons with disabilities in access to and subsequent use of the building, in accordance with applicable regulations that determine whether the building is suitable for appropriate improvements or no;
  • energy performance certificateof the building with identification label and registration with the competent authorities.
