TOURIST LICENSE

Tourist properties are any properties placed on the rental market and immediately available for holiday or leisure purposes.In accordance with decrees 92/2009 of 3 July and 75/2015 of 15 May of the Valencian Community Council, these properties are required to hold a tourist licence; failure to do so will result in an offence and the corresponding penalties.It is very important to obtain the tourist licence for the correct rental of your accommodation in order to comply with the legislation in force, and with the aim of ensuring the corresponding activity. WHO NEEDS TO APPLY ?

Natural or legal persons, whether they are the owners of touristic apartments or not, who transfer properties in conditions of immediate availability for use with a tourist, holiday or leisure purpose, provided that such transfer is made on an onerous and usual basis.

WHY IS IT NECESSARY ?

Obtaining a tourist license is essential when using platforms like Airbnb to advertise accommodations and services. Any advertisement for registered tourist properties must include their registration numbers and classification. Put simply, without a tourist license, it's impossible to advertise rental services on platforms like Airbnb or Booking as the license code must be included in all advertisements.

HOW TO PROCESS THE LICENCSE ?

The responsible body is the Territorial Tourism Service of the corresponding province where the property is located. It is necessary to go there with the following documentation:

  • Completed standard form.
  • ocuments verifying the physical or legal identity of the applicant.
  • First occupancy permit for the accommodations or, if not available, a certificate of their availability.
  • List of dwellings for tourist use.
  • Declaration of responsibility from the applicant regarding property availability and compliance with technical standards during the activity's validity period.

Once the form and documents are compliant, the Territorial Tourism Service will automatically register the property and issue a confirmation document. After this, the establishment must commence its activity within a maximum of two months.

WHAT HAPPENSE IN CASE OF NON-CONPLIANCE ?

Operating tourist activities without the proper license is a serious offense, resulting in fines and business closure. Customers are also prohibited from using the property beyond its capacity.

It is also forbidden to the clients the habitual use of the tourist property and/or the overnight stay in it of a number of persons superior to the maximum capacity of the housing or, where appropriate, of the one that had been fixed in the contract.

WHAT REQUIREMENTS DOES THE PROPERTY HAVE TO MEET ?

Above all, to apply for a tourist license, the property must have an occupancy license of first or second occupation.

All properties must be classified into three categories: superior, first or standard; and the minimum requirements are always the following:

  • Elevators for apartments above the 4th floor.
  • Thermal and acoustic insulation in all areas.
  • Hot water facilities.
  • Evacuation plan displayed on the property's door.
  • List of emergency contact numbers in a visible location.

A kitchen must have a stove with at least 2 hot plates, a fridge, an electric hob, a (microwave) oven.

The administration (l’Agència Valenciana del Turisme) may make the necessary checks regarding the compliance with the indicated requirements and the possession of the corresponding documentation.

 WHAT ARE THE APPLICABLE TAXES?

The tourist rental activity is associated with the automatic assessment of the resulting taxes. It is taxed in the same way as a city lease, which means that income from this activity is included in the annual profit and loss account.There is no need to register as a self-employed person, and there are no charges or VAT if it is managed by the owner. Tourist lettings are an accommodation service, not an establishment.
