Autorisation to Occupy Common Areas

If you need to place a container for the removal of construction waste, order a permanent parking space or design a terrace with tables for a restaurant, you need to obtain a permit for occupation of a common area. What is all about and how to get it?

It is an official authorisation issued by the public administration to a physical or commercial person who needs to occupy a certain section of a street for his or her own purposes for a certain period of time. The permit can be requested for a temporary period of one month, six months or permanently.

This is the reservation of a specific section of a public road for the exclusive use of the person or organisation making the request. An application should be placed with intention to reserve the section closest to the place where the activity will take place, for example a facility or trash disposal unit, but keep in mind that the location where the reservation will take place may impact on traffic and pedestrians acirculation in the minor way.

What types of authorisations exist?

There are a wide variety of permits - for the installation of market stalls or trade counters, for the unloading and loading of building materials or goods, for the installation of fences, scaffolding for construction work, for the placement of a container for construction waste, and for car parking.

Why is it necessary to request this authorisation?

 Because it is a public space that we have no right to use for our own interests. The use of public spaces is regulated by the public administration and only it has the authority to determine whether a person/organisation really needs to use this space or whether there are other possibilities unrelated to the use of public spaces.

Who is entitled to obtain this authorisation?

Any physical or legal person may apply for permits for the temporary occupation or permanent use of public places if this is necessary for economic, educational or any other activity or for the holding of an important event.

If, once an application has been submitted, a permit is granted subject to certain conditions, these cannot be changed or disrupted. If the person responsible for the permit obtained does not fulfil the conditions, this will result in the immediate cancellation of the permit.  

How to obtain this authorisation?

Depending on the municipality, this may be done as follows:

  • In person, by submitting all the necessary documentation (this may vary depending on the type of permit) to the relevant official department of the municipality administration.
  • Through the Internet. Currently, almost all municipalities have their own websites where you can apply for any type of permit online.
  • Through a single-window service. Here you can submit an application, attaching all the necessary documentation, and the staff of this service will forward your documents to the appropriate department of the municipal administration.

Therefore, please note that this permit is mandatory for construction work, for unloading-loading of goods, for events and for reserving space for catering terraces or car parking.
