ENERGY EFFICIENCY IN BUILDING

Energy efficiency, applied in the field of architecture and construction, aims to reduce energy consumption while maintaining the same energy services without reducing the comfort or quality of life of users.

It is expressed in “KgCO2/m2 year”, a measured variable that expresses the ratio between energy consumption and carbon dioxide emissions generated based on the volume of a property during a year.

This result, after an analysis prepared by a competent technician (at the level of a new or existing construction project), is reflected in a technical certificate called Energy Efficiency Certificate or, often, with the acronym EEC.

ENERGY PERFORMANCE CERTIFICATE (EPC)

WHAT IS IT?

Royal Decree 235/2013 establishes the obligation to provide an energy certificate to buyers, users and tenants of buildings or parts of buildings. The certificate must include objective information on energy efficiency with reference values so that users can compare and assess the energy efficiency of the property. These reference values range from "A" (most efficient) to "G" (least efficient).

WHEN DID IT TAKE LEGAL EFFECTS?

As of June 1, 2013, all new and second-hand properties, both residential and commercial, that are the subject of a sale or rental, must have the Energy Efficiency identification label that is part of an energy certificate. – EPC.

WHO NEEDS TO APPLY?

The duty to apply is any natural or legal person in whose name the ownership of the property is registered, that is, the owner of the existing building or part of it.

WHEN IS IT MANDATORY?

  • Buildings or new constructions for residential and tertiary use (premises, shops, etc.)
  • Existing buildings or parts of buildings that are sold or rented, as long as they do not have a certificate.
  • Buildings or parts of buildings in which a public authority occupies a total useful area of more than 250 square meters and are frequented by the public.

WHO CAN DO IT?

WHAT VALIDITY DOES IT HAVE?

The energy efficiency certificate and its corresponding label have a maximum validity of 10 years. The owner may update it voluntarily, when he considers that there are variations in aspects of the building or part of it that could modify the final rating of the certificate. Likewise, it must be renewed when the owner of the property changes.

WHAT IMPACT DOES NOT COMPLY WITH THE DUTY TO OBTAIN THE ENERGY CERTIFICATE?

There are several consequences of not complying with the obligation to obtain the energy certificate:

– Inspections:

The Government of the Autonomous Community responsible for energy matters will provide the necessary certification to guarantee compliance and detect cases of misrepresentation or fraud in inspections.

– Complaints:

The buyer/tenant may claim against the seller/tenant for non-compliance with the General Law for the Protection of Consumers and Users, challenging the contract and claiming damages caused by the lack of information.

– Sanctions:

Both the owner and the agency responsible for the sale and/or lease may be sanctioned for the violation and may be financially fined. . The sanctions established in article 51.1 of the legal text are:

  • Minor infringements: up to €3,005.06
  • Serious infringements: €3,005.06 – €15,025.30
  • Very serious: €15,025.30 – €601,012.10

I ALREADY HAVE IT, WHAT DO I DO NOW?

Once you have obtained this technical certificate, in order to use it and present it before a notary, you must legalize it. The way to do this is by registering it with the competent territorial body. The procedure will be explained below.
